These Customer Terms of Service ("Terms") are a binding agreement between you ("you," "customer") and Kind Reaper Development LLC ("ShotCart," "we," "us"), the operator of the ShotCart platform at shotcart.app and shotc.art (the "Service"). These Terms govern your purchase of digital photographs from independent photographers through the Service. Separate terms apply to photographers who use the Service to sell photographs (see the Photographer Platform Agreement).
By scanning a ShotCart gallery code, selecting photos, and completing a purchase, you accept these Terms. If you do not accept these Terms, do not complete the purchase.
1. What ShotCart Is
ShotCart is a marketplace that lets independent photographers sell you digital photographs they took of you (or that you appear in or are otherwise entitled to receive). The photographer is the seller of the photographs and your counterparty for the purchase. ShotCart provides the platform, payment processing through Stripe, and digital delivery of the files you buy.
2. Your Purchase
2.1 What you get
When you complete a paid order, you receive a non-exclusive, royalty-free license to download, store, modify, display, distribute, and use the purchased digital photographs for any lawful purpose — including personal use (prints, albums, social sharing) and commercial use (branding, professional headshots, advertising, product marketing, websites, packaging, and similar). You may not (a) resell or sub-license the photographs as standalone photographs (for example, listing them on a stock-photo site for others to license), or (b) modify them in a way that materially misrepresents the photographer's work or the subject depicted.
Copyright in the photographs remains with the photographer. The license is granted by the photographer through ShotCart at the moment your payment is successful.
2.1.1 Third-party clearances are your responsibility
The license described above covers the photographer's own copyright in the image. If a photograph depicts identifiable individuals other than yourself, identifiable third-party trademarks, or copyrighted artwork that is not the photographer's, you are responsible for obtaining any model release, trademark consent, or other clearance required by applicable law before using the photograph commercially. Neither ShotCart nor the photographer warrants that any such third-party rights have been cleared.
2.2 Pricing and tax
Prices are set by the photographer and shown to you on the gallery before you complete checkout. If the photographer has enabled sales-tax collection, Stripe Tax will calculate and add applicable sales tax to your order based on your delivery location and the photographer's tax registrations. ShotCart's service fee is included in the price displayed to you and is not added on top.
2.3 Free photos
A photographer may offer one or more "free" redemption options on a gallery. Free options are limited to one redemption per gallery, regardless of how many free options are offered. After the free option is redeemed, paid packages remain available for purchase.
2.4 Delivery
On a successful payment, ShotCart provides a download page with short-lived signed URLs for each purchased photograph. Download links are valid for at least 24 hours. If a link expires, you can return to the gallery from the link you originally received and request fresh download URLs by signing back into the order with the access token in your gallery URL.
2.5 Gallery availability
Each gallery is available for a limited time after the photographer finishes uploading photographs — typically 90 days, longer if the photographer has subscribed to our Pro plan. After that window the gallery is permanently removed and the photographs are deleted from our storage. Purchase your photographs before the gallery expires.
3. Payment
Payments are processed by Stripe. By submitting payment information you authorize ShotCart and Stripe to charge your payment method for the amount of your order, including any applicable sales tax. Card and bank-account information is collected and held by Stripe and is never seen or stored by ShotCart.
4. Refunds and Disputes
4.1 Refund window
Because purchased photographs are digital content delivered immediately, all sales are final once the download is delivered, except as required by applicable law.
4.2 Damaged, missing, or wrong-file deliveries
If a download link does not work, the file is corrupt, or you received the wrong photograph, contact us at appsupport@shotc.art within 14 days of purchase with your order reference code (shown on the download page and your Stripe receipt) and we will work with the photographer to provide a replacement or, where appropriate, a refund.
4.3 Disputes about subject matter
Disputes about the content of a photograph (composition, subject identity, removal requests) are between you and the photographer. Contact the photographer first. If you cannot resolve the matter, contact ShotCart and we will mediate within reason and act under our Acceptable Use Policy if warranted.
4.4 Chargebacks
If you initiate a chargeback through your card issuer, ShotCart and Stripe will provide your card issuer with the evidence of your purchase (order reference, download timestamp, preview-watermarked photographs). Initiating a chargeback for a successfully-delivered order may result in suspension of your access to the Service.
5. Acceptable Use
You agree not to:
- Bypass or attempt to bypass any restriction on the Service (including the photo-watermarking system, gallery access controls, or download-link expiry).
- Use automated tools to scrape, copy, or download photographs you have not paid for.
- Resell, redistribute, or commercially exploit purchased photographs in violation of Section 2.1.
- Misrepresent your identity or impersonate another person.
ShotCart may suspend or terminate your access if you violate these Terms or our Acceptable Use Policy.
6. Privacy
Our Privacy Policy at shotcart.app/privacy describes how we collect, use, and retain personal information. Your purchase email is shared with the photographer who took the photographs so they can support you on the order.
7. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, ShotCart disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific photograph will be available at any specific time.
8. Limitation of Liability
To the maximum extent permitted by law, ShotCart's aggregate liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid to ShotCart for the order giving rise to the claim. ShotCart will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits or loss of data.
9. Indemnification
You agree to indemnify and hold harmless ShotCart, Kind Reaper Development LLC, and their officers, directors, employees, and agents from any claim, demand, loss, or damages arising out of your breach of these Terms, your misuse of purchased photographs, or your violation of any third-party right.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. The "Effective" date at the top of this page will reflect the most recent revision. For future purchases, the Terms in effect at the time of purchase apply.
