This Acceptable Use Policy ("AUP") governs the content and activity that is allowed on the ShotCart platform operated by Kind Reaper Development LLC ("ShotCart"). It applies to everyone who uses the Service — photographers, customers, and visitors. By using the Service you agree to this AUP. Photographers also accept the Photographer Platform Agreement, of which this AUP is a part.
1. Stripe-Required Restrictions
Because ShotCart is built on Stripe Connect, the categories of business, content, and activity prohibited or restricted by Stripe are also prohibited or restricted on ShotCart. Stripe maintains and updates its list at stripe.com/legal/restricted-businesses. The current Stripe list is incorporated by reference and may be updated by Stripe at any time. If a conflict ever exists between this AUP and Stripe's list, Stripe's list controls for the affected category.
2. Photography Subject Matter — What's Not Allowed
You may not upload, sell, or distribute through the Service:
- Any content prohibited or restricted by Stripe's posted business list referenced in Section 1, including categories Stripe treats as adult or sexual content. ShotCart processes payments through Stripe Connect; categories Stripe will not process cannot be sold through ShotCart, regardless of legality in your jurisdiction.
- Images of minors (individuals under the age of 18) obtained or distributed without verifiable parental or legal-guardian consent. Photographs of minors that are sexualized, exploitative, or intended to be so are strictly forbidden and may be reported to law enforcement.
- Images obtained by trespass, by recording in places where the subject has a reasonable expectation of privacy (restrooms, locker rooms, private homes without consent), or by other unlawful means.
- Images that violate a third party's copyright, trademark, right of publicity, or right of privacy — including images you did not take yourself, images that include identifiable copyrighted artwork as the subject without permission, or images of persons who have asked you to remove them.
- Images depicting graphic violence, hateful symbology directed at a protected class, or content that promotes terrorism or other violence.
- Images of intelligence, law-enforcement, or military personnel obtained or distributed in violation of applicable law.
3. Account, Identity, and Payment Conduct
You may not:
- Misrepresent your identity, impersonate another person, or operate a photographer account on behalf of an undisclosed third party.
- Provide false information during Stripe Connect onboarding or in your ShotCart account settings.
- Process transactions that are not bona fide photography sales — including using ShotCart as a generic payment processor, as a way to launder funds, or to evade Stripe risk reviews.
- Initiate or solicit chargebacks on completed orders without a legitimate basis.
- Use ShotCart to facilitate the sale of any product or service prohibited by Stripe or by applicable law.
4. Platform Conduct
You may not:
- Access the Service through automated scraping, bulk-download, or web-crawler tools, except for clearly identified search-engine indexing of public marketing pages.
- Probe, scan, or test the vulnerability of the Service or attempt to defeat any security mechanism (watermarking, gallery-access tokens, signed-URL expiry, rate limits).
- Use the Service to send spam, phishing, malware, or other harmful content to other users.
- Interfere with another user's normal use of the Service.
- Use the Service in a way that imposes a disproportionate load on our infrastructure (for example, uploading vastly more content than your plan permits, or running an automated rapid-fire creation of accounts or sessions).
5. Customer Conduct
Customers using ShotCart galleries may not:
- Attempt to download photographs they have not paid for, or screenshot/remove watermarks for any purpose other than personal-use evaluation before purchase.
- Redistribute, resell, sub-license, or commercially exploit photographs purchased through the Service, except as permitted by the Customer Terms of Service.
- Harass the photographer or other parties through the gallery, support channels, or in person.
6. Reporting Violations
If you encounter content or activity on the Service that violates this AUP, please report it by emailing appsupport@shotc.art with enough information for us to investigate (URLs, gallery links, order reference codes, screenshots). Reports about copyright infringement should follow our DMCA Policy. Reports involving imminent harm to a person should also be made to local law enforcement.
7. Enforcement
ShotCart may, at its sole discretion and without prior notice, take any of the following actions in response to a violation of this AUP:
- Remove or hide specific photographs, galleries, or orders.
- Suspend or terminate the offending account.
- Reverse, hold, or refund transactions.
- Notify Stripe, law enforcement, or other authorities where appropriate.
- Pursue civil remedies under the Photographer Platform Agreement or applicable law, including recoupment of losses from future payouts.
We will provide notice and an opportunity to remediate where doing so is reasonable and does not increase risk to others.
8. Changes
ShotCart may update this AUP from time to time as Stripe's lists change, as the law evolves, or as we observe new abuse patterns. The "Effective" date at the top of this page reflects the most recent revision.
